Version TW-2026.1, drawn up in Tongeren on 22 October 2026.

In short

On Second-hand you put a billiard table, pool table or accessories up for sale, and buyers find you through our website. We bring you together. You conclude the sale itself with the buyer, not with us.

  • Selling? You agree once to these terms and to our commission. That agreement applies to all your listings, including the listings we put online for you at your request. You can end it at any time.
  • Buying? You buy from the seller, not from GePe Biljarts. If the seller is a private individual, you have no right of withdrawal and no legal guarantee.
  • Conversations between buyer and seller run through our website. We read along to prevent abuse, and we hide e-mail addresses, telephone numbers and links.

Nothing here can ever detract from the rights the law gives you as a consumer. If GePe Biljarts itself sells something on Second-hand, the listing says "Seller: GePe Biljarts", and our usual general terms and conditions apply.

1. What Second-hand is

1.1 Second-hand is a section of www.gepe-biljarts.be where private individuals and businesses offer second-hand billiard, pool and snooker tables, table football tables and accessories.

1.2 GePe Biljarts publishes the listings, provides a conversation between buyer and seller and charges the seller a commission on a sale. We are not a party to the sale: we do not sell, we do not buy, we receive no payment for the goods and we give no guarantee on them.

1.3 Every listing states whether the seller is a private individual or a business. This is based on what the seller declares. With a private seller, the European consumer rights (right of withdrawal, legal guarantee) do not apply to the sale.

1.4 By default, listings are shown in order of publication, newest first. You can filter by category, price and municipality or region. If you filter by price, you only see listings with a fixed price.

2. Your agreement as a seller

2.1 Before your first listing, you expressly agree to these terms and to the commission in article 4, by ticking a box that is not ticked in advance.

2.2 That agreement is ongoing. It applies to all your later listings, including the listings GePe Biljarts creates and puts online for you at your request. We never put anything of yours online without you having asked us to. For every listing we publish for you, you receive an e-mail with the link. There you can check it, change it or take it offline.

2.3 As proof of your agreement, we keep the date and time, the IP address from which you agreed and the version of these terms that you accepted.

2.4 Ending it. You can end your agreement at any time, in your account or by asking us. From then on:

  • all your listings that are online go offline;
  • we ask for your agreement again for a new listing;
  • the commission remains due on what you sold before ending it.

2.5 Cooling-off period. If you sell as a private individual, you can withdraw this agreement within fourteen days of your first agreement, without giving a reason and at no cost, using the model form below or a simple statement. If you already sell something through Second-hand within those fourteen days, you expressly asked us to start straight away, and the commission on that sale remains due.

3. Your listing

3.1 You declare that you own what you offer or that you are entitled to sell it, and that your description and photos are accurate. Only use photos you took yourself or for which you have permission.

3.2 Not permitted: goods you may not sell (stolen, counterfeit, under seizure), misleading descriptions, goods other than billiards, pool, snooker, table football and accessories, and contact details in the text or in the photos.

3.3 A listing only goes online after GePe Biljarts has reviewed it. That review is a check of the form and of what is clearly not allowed. It is not a check of your ownership, of the condition of the goods or of the accuracy of your description.

3.4 A listing stays online for 60 days. A week before the end you receive an e-mail to renew it. After "sold" it remains visible for a few more days with that mention.

3.5 If we refuse a listing, take it offline or block your account, we let you know what we did, why (which law or which article of these terms), whether it happened automatically, and how you can respond. You can always reply to us with your comments; you can also go to court.

4. Commission

4.1 If you sell through Second-hand, you pay GePe Biljarts a commission of 8% of the sale price, with a minimum of 25.00 euros, including VAT. Example: for a sale price of 1,000 euros you pay 80.00 euros.

4.2 The commission is due as soon as you set the listing to "sold". You then choose the buyer from your conversations and enter the sale price. You immediately receive an invoice with a payment link. You pay within 14 days.

4.3 The commission is also due if you sell to someone who came into contact with you through Second-hand, even if the sale is concluded outside the website or within 3 months after the listing went offline.

4.4 The percentage and minimum that apply are those in force at the time your listing went online. If we change the commission, this only applies to listings that go online afterwards. We notify you at least one month in advance, and you can then end your agreement free of charge.

4.5 There is no commission if your listing does not sell, or if you take it offline without selling.

5. Buying

5.1 You do not need an account. You enter your name and e-mail address (your telephone number is optional). You receive a personal link to the conversation with the seller. You can also simply reply to the e-mail.

5.2 You buy from the seller. GePe Biljarts has not seen the goods and does not vouch for their condition, ownership or delivery. Inspect what you buy before you pay, and never pay in advance to someone you do not know.

5.3 If the seller is a business, you have the rights the law gives you as a consumer towards that business. If the seller is a private individual, you do not.

6. Conversations

6.1 Conversations between buyer and seller run through our website or by e-mail via our address. Nobody sees the other person's e-mail address or telephone number.

6.2 GePe Biljarts reads along with all conversations, to prevent fraud and abuse and to protect the commission.

6.3 We hide e-mail addresses, telephone numbers and links automatically: they appear as "[hidden]". This is done by software, not by a person.

6.4 Be polite. Spam, threats, fraud and circumventing the filter are prohibited and may lead to listings being taken offline or your account being blocked (see 3.5).

7. Reporting something

7.1 If you see a listing or message that you believe is illegal or contrary to these terms, use the "Report this listing" button. State why, your name and your e-mail address, and confirm that your report is accurate and made in good faith.

7.2 We review every report carefully and let you know what we decided.

7.3 Our point of contact for users and for authorities: the form at www.gepe-biljarts.be/contactus. We reply in Dutch, French, German and English.

8. Tax information (DAC7)

8.1 The law requires us to pass on information to the FPS Finance about sellers who, in a calendar year, make 30 or more sales or receive more than 2,000 euros in total: name, address, national register number or foreign tax identification number, date of birth and, for businesses, the VAT and company number, together with the number of sales and the amounts.

8.2 We ask for that information when your sales reach that threshold. You receive an overview of what we passed on every year.

8.3 If you do not provide it, after two reminders and sixty days we must block you from new listings until you provide it.

9. Liability

9.1 GePe Biljarts is not liable for the content of users' listings and conversations, nor for the sale between buyer and seller, unless we fail to act quickly enough after a report or unless the law provides otherwise.

9.2 For listings we draw up at your request, you check the text as soon as you receive the e-mail. Anything you do not have changed, we consider accurate.

9.3 As a seller, you indemnify GePe Biljarts against claims by third parties concerning your listing or your sale.

10. Privacy

How we use your data is set out in our privacy statement at www.gepe-biljarts.be/privacy, chapter Second-hand.

11. Applicable law and courts

These terms are governed by Belgian law. If you are a consumer, you retain the protection of the law of your country of residence and can go to the court of your place of residence. In the event of a dispute, you can also turn to the Consumer Ombudsman Service (www.consumentenombudsdienst.be).
